A 23-year-old Ojo Caliente man was charged with rape, criminal sexual contact of a minor and contributing to the delinquency of a minor after it was discovered he was having sex with a 16-year-old girl, according to court documents.

The documents provide the following description of the arrest:

The mother of Joshua Quintana’s 16-year-old girlfriend originally reported Quintana to police Sept. 30 as an unwanted person in her house, but did not report a sexual relationship between him and the minor. He was not present at the woman’s Española residence that day when Española Police went looking for him, but he was located Oct. 1 during a subsequent police visit to the home after the mother called a second time.

Quintana was hiding in a bedroom underneath blankets when the victim, his girlfriend, told police he wasn’t in the house. Quintana denied having a sexual relationship with the victim, but when brought in for questioning, the victim claimed they were having protected sex every day, and her mother knew about it.

The victim said she and Quintana had been dating for six months after meeting at a party, and said he also provided marijuana that they smoked together. Officers originally charged her with harboring a criminal, Española Police Sgt. Christian Lopez said, but the charges were forwarded to the Juvenile Probation Office. He said the District Attorney’s office will determine whether the victim’s mother will face any charges.
