(SUNfoto by Andrew Kasper) Nathan Montoya pleaded not guilty May 12 in state District Court in Tierra Amarilla to felony charges stemming from the March 8 death of 17-month-old Breandra Peña. Montoya faces charges of child abuse resulting in death and tampering with evidence. Assistant District Attorney Dorie Biagianti-Smith requested Montoya’s bond be set at $1 million cash-only, calling it a serious and horrific case. She also said Peña’s mother and father were adamant Montoya not be released from jail and were fearful for themselves. Montoya’s defense attorney Mike Jones called the request excessive. Judge Sheri Raphaelson set bond at $500,000 cash-only, which Montoya did not post. He was transported to Santa Fe County Jail after the hearing.
