‘Red Flag’ Law Unconstitutional

    I would like to respond to state Rep. Susan Hererra’s guest commentary regarding her vote for the “red flag” law. This law denies due process to the accused and it denies a person to be secure in their home against unreasonable search (IV Amendment), when no crime has been charged.

    How can a search warrant be issued on hearsay? You have a right to a trial by a jury and the right to confront witnesses against you. (VI Amendment)

    According to this law you have to prove your innocence. That goes against the natural law that this country was founded on which is contained in the IX Amendment, which states, “The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.”

    The Constitution was written to constrain the people we elect to represent us. This law is misguided. Rep. Herrera should direct her efforts to how society has changed. I grew up carrying and using a firearm as did many of my friends.

    Should we trust the government to use discretion and sound judgment when enforcing this law? All one has to do is recall our previous sheriff who is in prison for shoving a badge in a man’s face.
