A restraining order against Española Mayor John Ramon Vigil has been extended for another 90 days.
The city of Española employee originally filed the petition for an order of protection against domestic abuse against Vigil on June 27, after New Mexico State Police publicly released a police report she filed, accusing Vigil of sexually assaulting her at a Santa Fe restaurant in October 2024. In the report, the victim also said that Vigil threatened her employment and harassed her by phone and at work.
This is the second time the restraining order has been extended. A hearing is scheduled in First Judicial District Court on Nov. 6, to determine whether it will be extended again.
Vigil and his attorney Elden Pennington both declined to comment on the extension of this restraining order. The victim’s attorney Jacob Candelaria did not return a request for an interview by press time.
According to the latest extended order, Vigil must keep 100 yards away from the victim’s home, school and workplace. In public places, like stores, he must maintain a distance of 25 yards.
The order also goes into detail about how both parties will make reasonable accommodations so they can continue performing their city job duties.
The victim, referred to as the petitioner in the order, must notify a city representative at least 24 hours in advance if she plans to go to City Hall or a city sponsored event. Vigil may not be present at these locations for the date and duration of her stay.
She is encouraged to conduct business away from City Hall, when possible. If her presence is required, she may attend city council meetings virtually and is to have no direct communication with Vigil.
