Case Charging 1 With Trafficking Fentanyl Bound Over to District Court

A Santa Fe man was bound over to Rio Arriba District Court on charges of trafficking with intent to distribute fentanyl and possession of a controlled substance: methamphetamine, after waiving his right to a preliminary hearing.

Daniel Roybal, 40, was initially charged with a third offense, speeding over 11-15 mph, which was dropped when he was bound over to District Court on Aug. 8.

He did not add any stipulation to the waiver of his preliminary hearing, like a requirement for lesser charges or the outlines of a plea deal.

New Mexico State Police Officer Oshane Greene charged Roybal on May 12 with the three offenses, after clocking him going 37 in the 25 mph zone on McCurdy Road. The traffic stop escalated when Greene found Roybal to be “more nervous than usual” and then spotted a pistol on the driver’s side floorboard of Roybal’s car, Greene wrote in a criminal complaint.

As he was getting out of the car, he allegedly stuck something from his pocket in the driver’s side door and told Greene he had methamphetamine in his pocket, Greene wrote.

When Greene searched his car, he found a 15 gram bag of white powder he believed to be fentanyl, leading to the trafficking charge, Greene wrote.

No arraignment date has been set.

Roybal was released on his own recognizance on May 13 by Rio Arriba Magistrate Judge Joseph Madrid.
