Chris Ortiz, 41, of Española, was one of three offenders in the 22-case sample reviewed by the SUN who was sentenced to jail time after entering a plea. He received the most jail time of any offender in the sample: a 19-year sentence.
Ortiz allegedly raped and molested his girlfriend’s 5-year-old daughter between Feb. 14 and Oct. 18, 2003, a State Police report states. The girl’s older brother told police he witnessed Ortiz exposing himself to her, reading “dirty things out of magazines” to her and touching her, according to the report.
Ortiz was charged March 18, 2004, with two counts of first-degree criminal sexual penetration, two counts of second-degree criminal sexual contact of a minor, two counts of child abuse and a single count of attempt to commit a felony, court documents state. He pleaded no contest to two counts of third-degree criminal sexual penetration and attempted criminal sexual penetration of a minor.
He was sentenced Nov. 17, 2005, to three years on each criminal sexual contact charge and nine years on the attempted criminal sexual penetration charge, court documents state. Because he had two previous felony convictions, he had a four-year habitual offender sentence enhancement added to one of the criminal sexual contact counts. He’ll have to serve at least 85 percent of his sentence, even if he earns good time. He has to register as a sex offender and serve two years on parole after his release.
