Under state law, criminal sexual penetration results when someone causes another person to engage in sexual intercourse of any kind without their consent. A minor is anyone under 18. The age of consent is 16, but if the perpetrator is in a position of authority over the victim or does not have their consent, the act is considered criminal.
Criminal sexual contact is touching or application of force to a person’s “unclothed intimate parts” without their consent or causing a person to touch one’s intimate parts by use of force or coercion.
Sentencing guidelines:
Criminal sexual penetration in the first degree: minimum 18-year sentence
Criminal sexual penetration in the second degree: sentence of three to 15 years
Criminal sexual penetration in the third degree: sentence of zero to six years
Criminal sexual penetration in the fourth degree: sentence of zero to 18 months
Criminal sexual contact of a minor in the second degree: sentence of three to 15 years
Criminal sexual contact of a minor in the third degree: sentence of zero to 6 years
Criminal sexual contact of a minor in the fourth degree: sentence of zero to 18 months
Previously convicted felons can have their sentence enhanced depending on how many times they have been convicted of a felony.
