A 25-year-old South Carolina man is accused of beating the woman he lives with because he allegedly was angry that she was on her phone.
Dayvon Smith faces one charge of domestic violence after the Nov. 25 incident on Camino del Sol. Española Police Officer Lucas Sanchez responded to a domestic violence call and spoke to the woman involved, who said Smith left on foot and was wearing all-black, he wrote in his incident report.
Officers tried to find Smith and were able to, after a bystander said a man matching Smith’s description was seen on the roof of a nearby building, the officer wrote.
“Upon officers searching the area the male was found hiding under a stair case,” Sanchez wrote. “When I asked the male his name he gave the name Dayvon Smith. After confirming that this male was involved in the domestic incident, I was able to gather more information from (victim).”
The woman told Sanchez that she and Smith were not in a relationship, but he did live with her. She said she was on her phone and Smith became agitated because he doesn’t like when she’s on it. Smith then took the phone away and wouldn’t give it back, Sanchez wrote.
“Mr. Smith began to hit her with a closed and open hand when she was trying to leave the area,” he wrote. “(Victim) stated Mr. Smith then blocked the doorway, took her glasses and turned off all the lights in order to prevent her from leaving. (Victim) stated, Mr. Smith than (sic) began to straggle (sic) her after she attempted to yell for help.”
Sanchez noted that the woman had fresh scratch marks on her face and around her neck. After the altercation, Smith left the area and the woman called 911.
“After Mr. Smith was located I advised him he was being placed under arrest for battery against a house hold member,” Sanchez wrote.
Medics were called to evaluate the woman but she refused to go to the hospital. Smith was taken to the Española Hospital for a medical clearance.
